In patent infringement litigation against the U.S. government, under 35 U.S.C. § 1498, Ocean Tomo damages experts James Malackowski and Alexander Clemons testified on behalf of the plaintiff, SecurityPoint, in two bench trials before the U.S. Court of Claims in Washington, D.C. Their trial testimony related to damages owed by the government for infringement of patented technology relating to the stackable tray and tray cart system utilized by TSA at U.S. airport security checkpoints, first implemented by TSA in 2005. Based on the reasonable royalty framework and methodology put forward by Ocean Tomo’s damages experts, SecurityPoint was awarded over $170 million in damages, amounting to the largest ever patent infringement judgement against the U.S. government.
