Robert McSorley will join Shashank Upadhye, Partner at Upadhye Tang LLP. They will be exploring related topics such as:

- Retaining experts to address claims of commercial success and irreparable harm

Robert McSorley is a Managing Director in the Intellectual Property Disputes Financial Expert Testimony practice, working out of the Chicago office of Ocean Tomo, a part of J.S. Held. Mr. McSorley has 30 years of experience addressing the economic, financial, and accounting issues concerning commercial litigation. Mr. McSorley is regularly retained by generic pharmaceutical firms (defendants) involved with Hatch-Waxman litigation. Mr. McSorley has been involved in Paragraph IV disputes since 2005. In connection with these engagements, Mr. McSorley evaluates financial and economic evidence relating to the issue of commercial success, a secondary indicium of non-obviousness. In addition, he regularly evaluates claims of irreparable harm and the measures and amounts of damages for patent infringement.
Mr. McSorley holds a B.A. degree in Accounting from The Pennsylvania State University and a J.D. from the University of Pittsburgh. He is a CPA and a licensed attorney. Mr. McSorley is a member of the Licensing Executive Society, the American Institute of Certified Public Accountants, and the Federal Circuit Bar Association.
