Ocean Tomo Financial Experts Michelle J. Avery and Nicole McTernan joined Ocean Tomo Management Consulting group’s Drew Sills to author an article for IAM focused on Why Patent Litigators are Central to a Wide Range of Commercial Disputes. In their article, the team explores a “fundamental shift in commercial litigation, with Intellectual Property (IP) strategy, policy and other considerations broadly emerging as critical factors in litigation beyond traditional IP infringement”. The transition in the role of IP in commercial legal matters raises awareness of the need to consider IP issues in a wide range of case types including antitrust, breach of contract, fraud, attorney malpractice, and insurance matters, among others. They point to recent trends and growing recognition for the importance of IP in the venture capital market, private equity, government fund allocations and corporate lending.
The article explores IP issues related to a variety of case types. The observations, particularly the interconnectivity between IP and core business strategies both inside and outside the courtroom, are in large part the driving force behind Ocean Tomo’s expansion from an “IP only” firm to a broader Financial Expert, Management Consulting and Advisory firm.
