Complainant IngenioSpec filed a complaint pursuant to Section 337 of the Tarriff Act of 1930. IngenioSpec alleged that various Respondents, including Magic Leap, imported allegedly infringing electronic eyewear products incorporating augmented reality into the U.S. market. Ocean Tomo was retained by Respondent Magic Leap to provide opinions regarding the economic prong of the Domestic Industry (“DI”) requirement. Ocean Tomo analyzed IngenioSpec’s claimed domestic investments in plant, property, and equipment; labor and capital; and research and development; establishing that IngenioSpec failed to tie the claimed investments to the DI Product.
Results
The investigation settled prior to deposition or testimony. The trial team for Magic Leap included Eric Carnick and Daniel Hutton.
